| By purchasing and/or using FIVVA Networks services, You acknowledge that You have read, understood, and agree to be bound by all terms and conditions of the current TOS and any other policies or agreements made part of this agreement by reference. You agree that FIVVA Networks may update, update and amend from time to time and in its sole discretion with or without notice, these TOS and any other policies incorporated by reference into the FIVVA Networks agreement. Hosting account holder are fully responsible for uploaded site content. You will be held responsible for all actions performed by your account whether it be done by you or by others! If server security is compromised, the account holder is responsible for all violations of the current TOS, including SPAM. Customers are required and obligated to maintain all security on their servers. You are solely responsible for any and all backups of your data. FIVVA Networks may not be held accountable for any loss of data due to hardware or software failure. FIVVA Networks highly recommends daily backups for your hosting account protection for additional fee. Any and all additional charges that are incurred due to customer lack of monitoring or security are the responsibility of the customer. When accepted by FIVVA Networks, the order You submit creates binding contract between You and FIVVA Networks, consisting of the order and these TOS. Your Order is “ACCEPTED” by FIVVA Networks when You receive an electronic and/or other written confirmation of Your order or FIVVA Networks processes your initial payment for services, whichever occurs first. FIVVA Networks will maintain and control ownership of all IP numbers and addresses that FIVVA Networks may assign to you. FIVVA Networks may, in it's sole discretion, change or remove any and all IP numbers and addresses without notice at any time for any reason. FIVVA's Networks trademarks, tradenames, service marks, logos, other names and marks are the sole and exclusive property of FIVVA Networks. You may not use any of the foregoing in any advertising, publicity or in any other commercial manner without the prior consent of FIVVA Networks or in anyway misrepresent Your relationship with FIVVA Networks. FIVVA Networks will maintain and control ownership of all IP numbers and addresses that may be assigned by FIVVA Networks to You. FIVVA Networks may, in it's sole discretion, change or remove any and all such IP numbers and addresses. You agree to pay all FIVVA Networks fees for any additional services at FIVVA's Networks then current rate. FIVVA Networks may change the pricing of it's current and/or additional services at any time upon notice. |
| PAYMENTS & REFUNDS POLICY |
| All accounts are billed automatically monthly, quarterly, semi-annually, or annually. It's the customers responsibility to ensure that they have sufficient funds to cover this transaction. As a courtesy we will send an email notification at which point we will need to be provided with payment within 24 hours. If we do not receive a response within 24 hours the account will be deactivated and any accounts under that account plan. Any account deactivated due to non-payment will be deactivated and we require a reactivation fee of $25 usd to be paid prior to reactivating the account. We DO NOT REFUND payments for the 1st month of service, it's applicable for dedicated servers and ddos protection services. We DO NOT REFUND account reactivation fees, partial monthly fees, setup fees, domain transfer or registration fees, any fees for script/software setup and/or license leasing and etc., to accounts canceling after their 7 day initial account activation period. Therefore only prepaid full monthly fees existing on account will be REFUNDED COMPLETELY within 5 business days but exclude 25% of the penalty for hosting account termination. If you dispute a charge to your credit card issuer that, in FIVVA Networks sole discretion is a valid charge under the provisions of the current TOS, you agree to pay FIVVA Networks an "Administrative Fee" of not less than $100 and not more than $150 usd. |
| SPAM & UNSOLICITED COMMERCIAL E-MAILS |
| FIVVA Networks takes a zero tolerance approach to the sending of SPAM and unsolicited commercial e-mails over our network. Very simply this means that customer(s) of FIVVA Networks may not use or permit others to use our network to transact in SPAM. Customers of FIVVA Networks may not host, or permit hosting of, scripts, software, sites and/or information that is advertised by SPAM from other networks. Violations of this policy carry severe penalties, including completely termination of service immediately! |
| HOSTING ACCOUNT CANCELLATION |
| All requests for canceling accounts must be made via our support ticket system HERE with at least 10 days. You must have all account information to cancel hosting account. |
